Domestic Violence Charges

#1 Phoenix Domestic Violence Lawyer

The state of Arizona defines domestic violence as almost any criminal act. For example, assault, aggravated assault, kidnapping, criminal trespass, disorderly conduct, and criminal damage) that one family or household member commits against another.

How Arizona Law Defines Domestic Violence

More specifically, a crime is considered a “domestic violence” offense if any of the following apply:

  • The relationship between the victim and the defendant is one of marriage or former marriage, or of persons residing or having resided in the same household.
  • The victim and the defendant have a child in common.
  • The victim or the defendant is pregnant by the other party.
  • The victim is related to the defendant or the defendant’s spouse by blood or court order as a parent, grandparent, child, grandchild, brother or sister, or by marriage as a parent-in-law, grandparent-in-law, stepparent, step-grandparent, stepchild, stepgrandchild, brother-in-law or sister-in-law.
  • The victim is a child who resides or has resided in the same household as the defendant and is related by blood to a former spouse of the defendant or to a person who resides or who has resided in the same household as the defendant.
  • The relationship between the victim and the defendant is currently or was previously a romantic or sexual relationship.

Possible Consequences Resulting From A Domestic Violence Conviction

Domestic violence charges have severe consequences, whether the charges concern assault, aggravated assault, sexual assault or more.

If convicted, you could face counseling, probation, jail, prison, and loss of gun privileges. A conviction can also have a profound impact on your current child custody or future child custody arrangements.

The court will consider all aspects of the case such as the extent of any injuries, whether a weapon was used if you have any prior convictions, and more.
