Aggravated Assault

Understanding Aggravated Assault In Arizona

The common definition of aggravated assault in Arizona is the unlawful attack by one person upon another with the intent of inflicting serious bodily injury. Aggravated assault is not limited to physical assault using any body parts; it is also applicable to the use of guns, knives, baseball bats, a car or any other item that can be defined as a “deadly weapon” or “dangerous instrument.”

Sentences for an aggravated assault charge can range from probation up to seven years for a first offense. With prior convictions, penalties could increase to 35 years in prison.

Possible Defenses

Several defenses can be used in aggravated assault cases.

In person-to-person cases, self-defense is often a defense that we can exert on your behalf. This most commonly applies when a person uses physical force to protect him or herself against another’s unlawful use of physical force.

In vehicular aggravated assault cases, the state has to prove that the defendant caused the injury or accident and often is unable to do so because mechanical problems with the car or road conditions could have caused the accident.

We Understand How The Prosecution Thinks

Our criminal defense lawyers at Lane, Hupp, & Crowley, PLC, have extensive experience representing clients who are facing criminal allegations; we know how to investigate such matters and anticipate what the state will use against you. We also often consult with forensic experts to build the strongest defense possible.
