An Argument With UPS Ends in DUI

A bad case of road rage ended with a man being arrested for aggravated DUI, according to police reports.

Cody Wayne Dewitt, 36, was arrested after allegedly pursuing a UPS delivery truck and verbally accosting its driver. Dewitt, driving a white GMC pickup truck, cut off the UPS truck when it was heading eastbound on U.S. Highway 70 as the driver attempted to turn south onto 5th Avenue. According to the driver and a witness, Dewitt pulled into the parking lot and yelled obscenities at the UPS driver while he was unloading his truck.

Police arrived at the scene and found Dewitt in his truck in the middle of the lot. Officers found Dewitt behind the wheel and two children under the age of 15 in the vehicle. When questioned, Dewitt alleged that the UPS truck cut him off.

During the interaction with Dewitt, the responding officer reported that he could smell alcohol and that Dewitt exhibited several signs that indicated intoxication. Dewitt consented to a sobriety test, but failed it. Afterwards, he was given a portable breath test that registered that he had a breath-alcohol concentration or BAC of .13. Any individual with a BAC over .08 is considered intoxicated.

Dewitt was arrested for aggravated DUI because he had children in the truck with him. He was booked into the Graham County Jail.

Children and DUIs

When an individual is arrested for a DUI, they face harsh consequences. Those consequences are even harsher if they are also charged with endangering a child.

Aggravated DUI with a minor in the car is a felony in Arizona, carrying mandatory jail time, high fines, the required installation of an Interlock Ignition Device in your vehicle and the loss of your license. You will also be required to have an SR-22. This high-risk auto insurance provision ensures that your insurance company reports any lapse of coverage to the DMV. You insurance premiums will also increase, and you could be dropped by your current insurance carrier altogether, thereby being forced to find a much more expensive provider.

Building a DUI Defense

Arizona has some of the harshest DUI penalties in the nation and when a child is in the vehicle with a DUI driver, they become much more grim.
